In a child custody dispute, the court must ordinarily establish a time sharing plan that is in a child’s best interest and which provides for a shared parenting arrangement. In determining the best interest of a child, there is no presumption for or against the father or mother of the child when creating or modifying the parenting plan of the child, and what the court deems as what is in the best interest of the child. In awarding primary custody to one parent over the other, the court may not give preference based upon a parent’s financial status or condition.
The court must take all relevant and appropriate information into account in effort to make a fair and reasonable determination of how the child’s best interests will be served based upon the current circumstances.
Once the court makes a decision regarding regarding a time sharing plan, it may issue a court order allocating the parental rights and responsibilities for the care of the children.
